1. About these terms

These terms govern your use of the TillerWise application and related services (“the Service”). By creating an account you agree to be bound by these terms and our Privacy Policy. The Service is operated by TillerWise, trading as TillerWise, based in England, United Kingdom. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to create an account. By registering you confirm that you meet this requirement.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

4. Acceptable use

You agree not to:

• Upload content that infringes third-party rights.
• Use the Service to harass, abuse, or harm others.
• Attempt to gain unauthorised access to the Service or its infrastructure.
• Interfere with or disrupt the Service, including by automated means such as scraping or denial-of-service attacks.
• Use the Service for any purpose that is unlawful under the laws of England and Wales.

5. Your content

You retain ownership of all GPS tracks, session data, and other content you upload (“Your Content”). By uploading content you grant us a limited licence to store, process, and display it solely for the purpose of providing the Service to you. We do not claim any intellectual property rights over Your Content.

6. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or temporarily suspend the Service without prior notice. We are not liable for any loss resulting from downtime.

7. Limitation of liability

To the fullest extent permitted by law, TillerWise and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under the laws of England and Wales.

8. Termination

You may delete your account at any time from your profile page. We may suspend or terminate your access if you breach these terms. On termination, we will delete your data in accordance with our Privacy Policy.

9. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the application before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

10. Analytics and monitoring

We collect pseudonymous operational and product analytics to understand how the Service is used and to improve it. Browser-side analytics only run if you opt in through the consent banner or privacy controls. Server-side operational events and error monitoring continue to run under legitimate interest using your internal account identifier — no name, email address, or GPS data is transmitted. This processing is described in full in our Privacy Policy, including how to withdraw browser analytics consent at any time.

11. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
